Please read these Terms and Conditions of Sale for the Internet site (“Terms and Conditions of Sale”) carefully before placing an order for Products (“Product/s”) through our website. These Terms and Conditions of Sale together with our privacy policy and our Terms and Conditions of Use govern the contractual relationship with reference to this website as well as any purchase of the Products through the same site. Please select the “I accept” box in the Order confirmation section to accept these Terms and Conditions of Sale before submitting an order (“Order”). If you do not accept these Terms and Conditions of Sale it will be impossible to place orders of Products through the G. L. CREATIVE S.R.L. website.

These Terms and Conditions of Sale do not affect your statutory rights and in particular Italian Legislative Decree No. 206/2006 (“Consumer Code”) and Italian Legislative Decree No. 70/2003 (“E-commerce code”).

FORMATION OF CONTRACT

Online orders shall be placed as follows.

• When you decide to make a purchase, click on “Add to the trolley” to put the Product in the trolley. The order will be completed from the trolley by selecting the “Purchase now” By default the system allows Products to be purchased without having to register or sign up, identifying the user as “Guest”. In this case the user only has to give the information strictly necessary to process the order and to issue the purchase document. The difference between this user and one who is registered is that the latter can make use of his/her “customer area” to find information about the order, the order status, a record of purchases etc.
• Registration of your personal information is recommended so that you can access the reserved area. Registration involves insertion of a password, which you are required to keep secret and not disclose to third parties. G. L. CREATIVE S.R.L. guarantees a security procedure to recover the password for subsequent purchases should you forget it and the password will be kept safely (encrypted) in its own systems. You will be asked to insert your e-mail address. The address you give at registration will be where the order confirmation and all subsequent documents will be sent. It is, however, possible to specify a different delivery address when completing the order;should the delivery address and the address to be put on the sale document not coincide, G. L. CREATIVE S.R.L. guarantees that no information regarding cost (sale document) will be attached to the package being dispatched. In any case the sale document, if sent via e-mail, is always sent to the e-mail address specified during registration/placing the order.
• In the case of registered users, the account is accessed by inserting the registration data.
• The order gives details of all costs that will be charged, in other words related to products, accessories, any transport costs and applicable taxes. The Terms and Conditions of Sale must be fully accepted to complete registration of the order. You will then be asked to confirm the address for the sale document and the delivery address as well as your data for payment.
• Lastly, having collected all the necessary information, you will be asked to check that it is correct. Should you find any kind of error, the Order may be changed and errors corrected prior to submitting the order to G. L. CREATIVE S.R.L.. It is the user’s responsibility to check that the Order is correct before submitting it. If you have any problems with registering the Order, please contact G. L. • Authorisation for payment is obtained during order registration. If the user’s credit card company does not give authorisation, the order cannot be accepted and the procedure will be stopped.
• L. CREATIVE S.R.L. will send a first e-mail confirming receipt of the Order, containing a summary of the terms and conditions of sale applicable to the contract, information related to the main features of the Product as well as details regarding price, methods of payment and of withdrawal, delivery costs and any applicable taxes. The aforesaid e-mail will be sent automatically to the user’s registration address.
• L. CREATIVE S.R.L. will send a second e-mail when the package is ready for dispatch and awaiting collection by the express courier. The e-mail will include the sale document and the information necessary for checking delivery status (Tracking).
• If G. L. CREATIVE S.R.L. cannot accept the order for any reason, a G. L. CREATIVE S.R.L. representative will contact the user and G. L. CREATIVE S.R.L. will immediately refund any amount already charged to the Customer.

By submitting an Order the user makes an offer of purchase for the Product/s at the price specified therein, subject to acceptance by G. L. CREATIVE S.R.L.. The prices are checked regularly; however, should G. L. CREATIVE S.R.L. find differences in prices or pricing errors, it will contact the user asking for confirmation of the intention to proceed with the purchase at the correct price. Even if the user confirms the purchase order, G. L. CREATIVE S.R.L. is in any case under no obligation with regard to delivery of the Product until the second order confirmation e-mail. If the user realises that he/she has made a mistake when placing the Order, he/she should immediately contact G. L. CREATIVE S.R.L. at the following e-mail address ordini@6229jewels.com and inform them accordingly before the second Order confirmation e-mail is received. G. L. CREATIVE S.R.L. is unable to correct Orders after this time, but the user is in any case guaranteed the right to withdraw and return as specified hereinafter.

PAYMENT

The prices specified on the G. L. CREATIVE S.R.L. website are inclusive of VAT, if applicable. Delivery costs are applied to Orders less than a certain amount, as specified below. All payments shall be made at the time of ordering the Product/s by means of credit card. Prices may change at any time, but such changes do not affect Orders that are already confirmed in the ways described above.

CREDIT CARD PAYMENT

L. CREATIVE S.R.L. only accepts payments made through Visa, MasterCard, American Express, Maestro, Carta Si, using PayPal services; the PayPal account is also included in the services. Should G. L. CREATIVE S.R.L. for any reason be unable to accept an Order, it may, at its discretion, not proceed with the debit or refund the price already paid in respect of the Order within the time limit according to the law. G. L. CREATIVE S.R.L. will not send the Product/s until it has received full payment. In the case of payments by credit card, cardholders may be subject to authentication and request for authorisation. If the credit card issuer or our service provider refuse or for any reason do not authorise or validate payment, in such circumstances G. L. CREATIVE S.R.L. shall not be held responsible for delayed or non-delivery of the ordered Products. G. L. CREATIVE S.R.L. will process the user’s personal information in conformity with the privacy policy.

BANK TRANSFER

In case of payment by bank transfer, the Product/s will be maintained until the receipt of payment is sent to GL CREATIVE SRL by email to info@6229jewels.com not over 4 days from the data of acceptance of the Order . The sending of the order will only take place when the actual accredit of the amount due on the c / c GL CREATIVE SRL That will have to take place within 7 working days from the data of acceptance of the Order .

These deadlines exceeded, the Order will be automatically canceled .
The reason for payment must report the number of the Order of Reference , and the name of the Company.

DELIVERY

Although G. L. CREATIVE S.R.L. endeavours to comply with the timescales given in the Delivery times section for delivery of the Product/s to the specified address, it is unable to give a precise delivery date. Should the Product/s not be delivered, for any reason whatsoever including even temporary unavailability of the Product/s, within 45 days from the user sending the Order, or from a date otherwise agreed with the same, the user may cancel the Order and G. L. CREATIVE S.R.L. will refund the price and any other sums already paid by the user.

DAMAGED OR DEFECTIVE PRODUCTS

• You must inspect the Products at the time of delivery to check for any defects or damage, which shall be notified to G. L. CREATIVE S.R.L. using the following e-mail address ordini@6229jewels.com, within 2 (two) months. Pursuant to art. 128 and following of the Consumer Code, in case the Products will show any defect within 2 (two) years since their delivery, you shall claim such defects to G. L. CREATIVE S.R.L. using the following e-mail address ordini@6229jewels.com, no later than 2 (two) months since their detection. Products damaged by normal wear and tear ARE NOT considered defective products. If you discover that a Product has been delivered damaged, i.e. it is defective (not due to your use), you may proceed to request alternatively (a) the Product repairing; (b) the reduction of the price; or (c) the return of the Product with the related reimbursement request. G. L. CREATIVE S.R.L. will provide for the substitution / repairing / total or partial refund will refund the price paid including any delivery costs, provided that the Product has not been worn or used and damaged. • These Terms and Conditions of Sale do not exclude the liability of G. L. CREATIVE S.R.L. toward you for: death or personal injury; fraud; any circumstance on the basis of which it would be unlawful to exclude or limit our liability towards you in accordance with applicable legislation.
• Without prejudice to the preceding sub-clause (ii), G. L. CREATIVE S.R.L. is solely liable for losses that are a consequence of breaches by G. L. CREATIVE S.R.L. of these Terms and Conditions of Sale. Such liability is exclusively limited to the purchase price of the purchased Product and compensation for foreseeable damage. Damage is considered foreseeable if the parties could have foreseen them at the time G. L. CREATIVE S.R.L. accepted your Order.
• Without prejudice to the preceding sub-clause (iii), G. L. CREATIVE S.R.L. is not liable for consequential damage, that is, damage that is an indirect consequence of the main damage or loss, and which is not foreseeable by the parties, including, but not limited thereto: loss of earnings; loss of work opportunities; loss of profits or of contracts; or loss of savings;without prejudice to the fact that the foregoing does not preclude the right to bring action for the loss or damage suffered in accordance with applicable overriding provisions of law and with sub-clause (iii) or any other action for the compensation of direct damage not excluded by one of the aforesaid categories of damage specified in this sub-clause (iv).
• Without prejudice to the preceding sub-clause (iii), G. L. CREATIVE S.R.L. is not liable for failure or delay in performing its obligations pursuant to these Terms and Conditions of Sale due to causes beyond its control, including, by way of example: natural disasters, measures implemented by the authorities, war, fire, floods, explosions or uprisings, interruption of IT or telecommunication services, non-fulfilment by third parties (including non-fulfilment related to the provision of data) and strikes.

In any case the clauses of these Terms and Conditions of Sale do not restrict your statutory rights.

RIGHT TO WITHDRAW AND RETURN

If you are a consumer (i.e. you are not making a purchase, even in part, for your entrepreneurial initiative, profession, business or artisan activity) you are entitled, in addition to your other rights acknowledged by law and these Terms and Conditions of Sale, to withdraw from the contract entered into with G. L. CREATIVE S.R.L. for the purchase of the Products in accordance with these Terms and Conditions of Sale and in conformity with section 52 et seq. of the Italian Consumer Code (except for personalised or other Products for which non-return ability is expressly specified) and to be refunded by G. L. CREATIVE S.R.L. any sums already paid. If you intend withdrawing, you shall notify G. L. CREATIVE S.R.L. in writing thereof at the e-mail address ordini@6229jewels.com or by mail to G. L. CREATIVE S.R.L., Via Alessandro Volta 19 20121 Milan Italy E-commerce.com Office within 14(fourteen) days starting on the day after the date on which the Products were delivered to you and confirm by recorded delivery letter with advice of receipt within the following forty-eight hours. If you do decide to withdraw, you shall return the Products at your expense and risk and we would ask you to ensure that the Products are adequately insured during the return thereof. Stores in Italy may not accept your returns or exchange products. You shall take all reasonable measures to protect the Products. Details on the exercising of the right of withdrawal are given together with the document accompanying the Product. If the Products have been paid for with prepaid card, refunds will be made to the card originally used to make the purchase. All refunds will be made as quickly as possible and in any case within 14 (fourteen) days: from the e-mail by G. L. CREATIVE S.R.L. confirming the cancellation of your Order (when the Products have not been delivered to the specified address within 30 days following the Order); or  from receipt by G. L. CREATIVE S.R.L. of the returned Products.

OTHER INFORMATION

Certain Products may appear slightly larger or smaller than the real size or appear slightly different color due to defects of the screen (e.g. screen calibration) or photographic techniques. Other Products may be displayed in larger than real size so that the details can be clearly seen, or smaller than real size so that the whole Product can be seen.

In any case both the e-mails you will be sent will have a pdf file of the Terms and Conditions of Sale attached.

The contract and all communication between you and G. L. CREATIVE S.R.L. will be in Italian and in English.

The formation, existence, interpretation, performance, validity and all aspects relating to these Terms and Conditions of Sale are governed by Italian law.

Any dispute with consumers arising from or connected with these Terms and Conditions of Sale or use of the Site shall be settled by the Court of the place of residence or domicile of the consumer if located within the territory of an EU State. In any other case, included therein the circumstance in which the user is not a consumer pursuant to the applicable provisions of law, any dispute shall be settled by the Court of Milan.

Should any clause of these Terms and Conditions of Sale be considered invalid or unenforceable, it shall be considered as null and void while the remaining part of these Terms and Conditions of Sale shall remain valid and effective.

The delay or failure by G. L. CREATIVE S.R.L. to exercise any option, right or remedy set out in these Terms and Conditions of Sale shall not imply waiver thereof, nor shall the single or partial exercising of any one of such options, rights or remedies prevent the future or other exercise thereof.

DELIVERY DATES AND CALCULATED AMOUNT

The jewels are handmade, each piece is unique and is made by us after your purchase. The waiting time for gold jewellery can probably be more. G. L. CREATIVE S.R.L. evades the order within 5 working days and subsequently the courier DHL will deliver it according to the delivery time as in the following table.

Shipping charges are automatically calculated during the checkout process.
Deliveries to non-EU countries incur additional customs duties, taxes and charges. These are not included in the shipping costs and are invoiced separately from the parcel service.
